Rental Terms and Conditions
Effective Date: October 20, 2026
These Terms & Conditions govern the rental and use of vehicles provided by Speed. The individual or business renting a vehicle is referred to as the “Renter” or “Customer.”
By making a reservation, signing a rental agreement, paying for a rental, or accepting possession of a vehicle, the Customer agrees to the applicable terms of this Agreement and any vehicle-specific rental documents provided at booking.
1. Rental Eligibility and Driver Requirements
1.1. The Customer must meet the minimum age, licensing, insurance, and other eligibility requirements applicable to the selected vehicle and rental arrangement.
1.2. The Customer must possess a valid driver’s license and provide identification reasonably necessary to verify identity and eligibility.
1.3. Speed reserves the right to verify the Customer’s identity, driving eligibility, payment method, and other relevant booking information before releasing a vehicle.
1.4. The Customer must provide truthful and accurate information during the booking process. Material misrepresentations may result in reservation cancellation or termination of the rental, subject to applicable law and the terms of the rental agreement.
1.5. No person may operate a rental vehicle unless approved and authorized in writing by Speed.
1.6. Speed may refuse or cancel a rental when the Customer fails to meet eligibility requirements, cannot complete required verification, or presents a legitimate safety, payment, or fraud concern, subject to applicable law and any applicable refund obligations.
2. Reservations and Vehicle Availability
2.1. Reservations are subject to vehicle availability, payment authorization, and confirmation by Speed.
2.2. A reservation is not final until the Company confirms the booking and communicates any required payment, deposit, identification, and documentation requirements.
2.3. Vehicle makes, models, colors, features, and availability may vary. If a reserved vehicle becomes unavailable, Speed may offer a comparable alternative subject to the Customer’s agreement or provide an appropriate refund for the unavailable rental, as applicable.
2.4. Customers must provide accurate pickup, delivery, and return information. Changes to a confirmed reservation must be approved by Speed.
2.5. Photographs and promotional materials are illustrative unless a specific vehicle is expressly confirmed in the reservation.
3. Rental Rates, Fees, and Payment
3.1. The Customer agrees to pay the rental rate, applicable taxes, delivery fees, optional services, and other charges disclosed before or during booking, as applicable.
3.2. Rental rates may vary based on vehicle selection, rental duration, demand, holidays, special events, and other disclosed pricing factors.
3.3. Payment must be made using a payment method accepted by Speed. The Company may require payment authorization or verification before releasing the vehicle.
3.4. The Customer authorizes Speed to collect agreed rental charges and other properly disclosed amounts due under the signed rental agreement, subject to applicable law and payment authorization requirements.
3.5. Any additional charges arising after the rental, including documented damage, tolls, tickets, or approved extensions, will be handled in accordance with this Agreement and applicable law. Speed will provide supporting documentation when reasonably available.
3.6. Customers are responsible for any applicable bank fees, declined-payment charges, or third-party fees only to the extent those charges are lawful and were appropriately disclosed.
4. Security Deposit and Payment Authorization
4.1. Speed may require a refundable security deposit or payment-card authorization before releasing a vehicle. The required amount will be disclosed before the rental is finalized.
4.2. A security deposit may be applied to lawful, documented amounts owed under the rental agreement, including unpaid rental charges, applicable tolls, authorized fees, or qualifying damage charges for which the Customer is responsible.
4.3. Any remaining refundable balance will be released or returned after the rental and reasonable post-rental review, subject to outstanding transactions, payment processor timelines, and applicable law.
4.4. If a claim or charge remains unresolved, Speed will communicate the basis of the proposed deduction or charge and handle the matter in accordance with the rental agreement and applicable law.
4.5. A deposit is not a limit on liability for amounts lawfully owed, nor does it automatically establish that the Customer is responsible for every loss involving the vehicle.
5. Pickup, Inspection, and Return
5.1. The Customer must inspect the vehicle at pickup and promptly report visible damage, warning lights, missing equipment, or other concerns before departing.
5.2. Speed and the Customer may document the vehicle’s condition through photographs, video, written inspection reports, and mileage records.
5.3. The Customer must return the vehicle at the agreed time, date, and location, with all keys, accessories, and supplied equipment.
5.4. The vehicle must be returned in substantially the same condition as received, except for ordinary wear consistent with proper use.
5.5. The Customer must promptly report any mechanical issue, warning light, collision, or other condition that could affect the vehicle’s safety or operation.
5.6. The Customer may not abandon the vehicle, leave it unsecured, or transfer possession to an unauthorized person.
6. Late Returns and Rental Extensions
6.1. Rental extensions must be requested and approved by Speed before the scheduled return time. An extension is not effective until confirmed by the Company.
6.2. If a vehicle is returned late without an approved extension, additional rental charges may apply according to the disclosed late-return schedule or applicable rental agreement.
6.3. If a delay prevents the next confirmed reservation from being fulfilled, Speed may pursue documented losses or other remedies available under the rental agreement and applicable law.
6.4. Customers must promptly contact Speed if they anticipate a late return. Failure to communicate does not automatically authorize an extension.
6.5. Any grace period, hourly rate, or additional-day charge will be specified in the applicable booking terms. No undisclosed penalty will be imposed.
7. Authorized Use and Prohibited Activities
The Customer agrees to operate the vehicle responsibly, lawfully, and in accordance with the vehicle manufacturer’s instructions.
The following activities are prohibited unless expressly authorized in writing and legally permitted:
Allowing an unauthorized person to drive or take possession of the vehicle.
Racing, speed contests, track use, drifting, burnouts, or reckless driving.
Driving under the influence of alcohol, illegal drugs, or impairing substances.
Using the vehicle to commit or facilitate unlawful activity.
Using the vehicle for rideshare, taxi, delivery, commercial transportation, or other commercial purposes not expressly authorized.
Subleasing, lending, selling, pledging, or otherwise transferring possession of the vehicle.
Driving off-road or on unsuitable surfaces likely to damage the vehicle.
Tampering with GPS devices, security systems, odometers, or vehicle electronics.
Removing vehicle identification, registration, or safety equipment.
Using the vehicle outside authorized geographic limits or taking it outside the United States without prior written approval.
Smoking or vaping inside the vehicle, if prohibited by the applicable vehicle-specific rental terms.
Transporting prohibited hazardous materials or using the vehicle in a manner that violates applicable law.
A material violation may result in termination of the rental where legally permitted, recovery of the vehicle through lawful means, and responsibility for documented losses caused by the violation.
8. Mileage and Geographic Restrictions
8.1. Each reservation will specify any included mileage allowance, if applicable.
8.2. Excess mileage charges may apply only at the rate disclosed in the applicable booking terms or rental agreement.
8.3. Geographic restrictions, including limits on travel outside Florida or designated areas, must be disclosed before the rental is finalized.
8.4. The Customer must obtain written approval before exceeding any stated mileage allowance or geographic restriction when approval is required by the rental agreement.
9. Insurance and Financial Responsibility
9.1. Before vehicle release, Speed will communicate applicable insurance requirements and any relevant coverage information for the rental arrangement.
9.2. The Customer must comply with all applicable insurance requirements and accurately disclose information necessary to determine eligibility for the rental.
9.3. The existence of insurance must not be interpreted as a guarantee that every accident, loss, driver, use, or circumstance is covered.
9.4. The Customer may be responsible, to the extent permitted by law and the applicable insurance policy and rental agreement, for losses arising from unauthorized use, excluded conduct, policy violations, or other circumstances for which the Customer is legally responsible.
9.5. Nothing in this Agreement expands, replaces, or guarantees insurance coverage beyond the terms of the applicable policy.
9.6. Customers should review the applicable rental agreement and insurance documents for coverage limitations, deductibles, exclusions, and claims procedures.
10. Vehicle Damage, Theft, and Loss
10.1. The Customer must take reasonable care of the vehicle and promptly notify Speed of any damage, theft, attempted theft, vandalism, mechanical failure, or other loss.
10.2. If the vehicle is damaged during the rental, the Customer must cooperate with reasonable inspection, documentation, insurance, and claims procedures.
10.3. Where the Customer is legally responsible, charges may include reasonable and documented repair costs, applicable insurance deductibles, towing, recovery, and other recoverable expenses permitted by law and the rental agreement.
10.4. Loss-of-use charges, diminished-value claims, administrative charges, or similar amounts will be assessed only where legally recoverable, supported by an appropriate basis, and disclosed or otherwise permitted under the applicable agreement and law.
10.5. The Customer will not be charged for pre-existing damage merely because it is discovered after the rental. Vehicle condition records, inspection photographs, repair documentation, and other relevant evidence may be used to evaluate responsibility.
10.6. Speed will not treat a damage allegation alone as conclusive proof of liability. Responsibility will be evaluated using the available evidence, applicable contract terms, insurance provisions, and law.
11. Accidents, Emergencies, and Roadside Assistance
11.1. In the event of an accident, the Customer must stop in a safe location, contact emergency services when necessary, and comply with applicable reporting requirements.
11.2. The Customer must promptly notify Speed and provide relevant information, including photographs, incident details, and the information of other involved parties when lawfully available.
11.3. The Customer must not admit legal liability on behalf of Speed, make unauthorized settlement commitments, or arrange substantial repairs without authorization, except for reasonable emergency measures needed to protect life or prevent further immediate harm.
11.4. If the vehicle becomes unsafe or inoperable, the Customer must contact Speed for instructions and use available roadside assistance as directed, where appropriate.
11.5. The Customer must not abandon the vehicle or arrange unauthorized towing, except when necessary for immediate safety or required by law.
12. Fuel, Cleanliness, and Vehicle Care
12.1. The vehicle must be returned with the fuel or battery charge level required by the applicable rental terms.
12.2. Refueling, charging, cleaning, or reconditioning charges may apply when disclosed in advance and reasonably supported by the condition of the returned vehicle.
12.3. The Customer may be charged for excessive cleaning or remediation required because of spills, stains, smoke, odors, pet hair, unauthorized modifications, or other conditions beyond ordinary use, where the charge is lawful and documented.
12.4. The Customer must use the correct fuel type and follow any special operating or charging instructions supplied with the vehicle.
12.5. The Customer must not modify, wrap, tint, install accessories on, or otherwise alter the vehicle without written approval.
13. Tolls, Parking, Traffic Violations, and Impoundment
13.1. The Customer is responsible for tolls, parking charges, traffic citations, and other violations attributable to the Customer’s use or possession of the vehicle during the rental period, subject to applicable law.
13.2. Where legally permitted, Speed may provide rental records to the relevant authorities or tolling agencies to identify the responsible renter.
13.3. Reasonable, disclosed administrative charges may apply when Speed processes violations or tolls on the Customer’s behalf.
13.4. If the vehicle is impounded or towed because of the Customer’s conduct or violation, the Customer may be responsible for legally recoverable costs attributable to that conduct.
13.5. The Customer must promptly notify Speed if the vehicle is ticketed, impounded, seized, or otherwise prevented from being returned normally.
14. GPS Tracking and Vehicle Security
14.1. Certain vehicles may be equipped with GPS tracking, telematics, or other security technology.
14.2. Where applicable, such technology may collect location, mileage, vehicle status, and related operational information for vehicle security, maintenance, recovery, safety, and legitimate contractual purposes.
14.3. The Customer acknowledges any applicable tracking disclosures provided with the rental agreement and privacy policy.
14.4. The Customer must not disable, remove, obstruct, or tamper with vehicle security systems.
14.5. Tracking information will be handled in accordance with applicable law and Speed’s Privacy Policy. Tracking will not be used for unlawful purposes.
15. Cancellation, No-Shows, and Early Returns
15.1. Cancellation deadlines, refund eligibility, and any cancellation charges will be disclosed in the booking terms applicable to the reservation.
15.2. Failure to arrive at the agreed pickup time without communicating with Speed may be treated as a no-show under the disclosed booking policy.
15.3. Refunds for cancellations, no-shows, or early returns will be handled according to the agreed cancellation policy and applicable law.
15.4. If Speed cancels a confirmed reservation because the vehicle is unavailable and no mutually acceptable substitute is provided, the Customer will receive any refund required by the applicable booking terms and law.
15.5. Nothing in this section permits Speed to retain a payment or impose a penalty where doing so would violate applicable law.
16. Termination and Vehicle Recovery
16.1. Speed may terminate a rental where permitted by law if the Customer materially breaches this Agreement, fails to maintain required eligibility, provides materially false information, engages in prohibited use, or presents a legitimate and substantial vehicle safety or security concern.
16.2. Upon lawful termination, the Customer must follow instructions for returning the vehicle and may not continue using it without authorization.
16.3. If a vehicle is not returned as required, Speed may take lawful steps to recover it, including contacting appropriate authorities where warranted.
16.4. Speed will not use unlawful self-help, threats, or other prohibited methods to recover a vehicle.
16.5. The Customer remains responsible for amounts lawfully due under the Agreement, subject to applicable defenses, insurance provisions, and legal requirements.
17. Privacy and Confidentiality
17.1. Personal information collected during the booking and rental process will be handled in accordance with Speed’s Privacy Policy.
17.2. Speed may use Customer information for identity verification, payment processing, reservation management, customer service, vehicle security, fraud prevention, and legal compliance.
17.3. Speed will take reasonable measures to protect Customer information and limit access to authorized persons and service providers.
17.4. Customer information will not be disclosed publicly for promotional purposes without appropriate authorization, except as permitted or required by law.
17.5. Customers should review the separate Privacy Policy for further information regarding information collection, retention, sharing, and applicable privacy rights.
18. Limitation of Liability
18.1. Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by law.
18.2. To the extent permitted by law, Speed is not responsible for personal belongings left in a vehicle after the rental period, although reasonable efforts may be made to facilitate their return.
18.3. Speed does not guarantee uninterrupted vehicle availability or that a vehicle will be free from every mechanical issue. If a mechanical issue arises, Speed will address it in accordance with applicable law, the rental agreement, and any relevant insurance or roadside assistance arrangements.
18.4. Nothing in this section removes any nonwaivable rights or remedies available to the Customer.
19. Disputes and Governing Law
19.1. The parties are encouraged to contact one another promptly and attempt in good faith to resolve disputes arising from a rental.
19.2. This Agreement will be governed by the laws of the State of Florida, without disregarding any mandatory legal protections that apply.
19.3. Any court proceeding will be brought in a court with appropriate jurisdiction and venue under applicable law.
19.4. Any arbitration, class-action waiver, attorney’s fee provision, or other special dispute-resolution requirement must be set out in a separate, properly drafted provision where legally appropriate. Nothing in this Agreement automatically requires arbitration or waives a right that cannot legally be waived.
20.5. Electronic signatures and electronic acceptance may be used to the extent recognized by applicable law.
20.6. If a translation is provided, the parties should identify the controlling version of the Agreement in the signed rental documents.
